1. Agreement to Terms

By accessing or using Cryptoffsize (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Cryptoffsize ("we", "us", or "our") governing your use of our cold wallet platform and related services.

2. Description of Service

Cryptoffsize provides a secure cold wallet platform for cryptocurrency management, specifically:

• USDT (TRC20) - Tether on TRON blockchain
• TRX - TRON native token

Our services include:

• Cold wallet creation with offline private key storage
• Cryptocurrency deposits and withdrawals
• Real-time transaction tracking
• Referral program with commission-based earnings
• Email-based two-factor authentication (2FA)
• Transaction history and analytics

3. Eligibility

To use the Platform, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Platform under any applicable laws
• Not be a resident of a jurisdiction where cryptocurrency services are prohibited
• Provide accurate and complete registration information

4. Account Registration and Security

4.1 Account Creation

To use the Platform, you must create an account by providing:

• A valid email address
• A secure password (minimum 8 characters)
• Optional referral code (if referred by another user)

4.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your email account is secure, as it is used for 2FA verification

4.3 Email Verification

You must verify your email address before using withdrawal features. Email verification is required for security purposes and to enable two-factor authentication for withdrawals.

5. Cold Wallet Technology

5.1 Private Key Storage

All private keys are stored in an encrypted cold wallet system, meaning they are kept offline and never exposed to the internet. Private keys are encrypted using AES-256 military-grade encryption.

5.2 User Responsibility

CRITICAL: While we store your private keys securely in our cold wallet system, you acknowledge that cryptocurrency transactions are irreversible. Once a transaction is confirmed on the blockchain, it cannot be reversed or refunded by us.

5.3 No Recovery Guarantee

If you lose access to your email account or forget your password, we will attempt to help you recover your account through our support process. However, we cannot guarantee account recovery in all cases.

6. Deposits and Withdrawals

6.1 Deposits

• Deposits are credited after blockchain confirmation (typically 1-3 minutes for TRC20)
• You must send only USDT (TRC20) or TRX to your designated wallet address
• Sending other cryptocurrencies or using wrong networks will result in permanent loss of funds
• We are not responsible for deposits sent to incorrect addresses

6.2 Withdrawals

• Minimum withdrawal: $10 USDT or 100 TRX
• Platform fee: 2% per withdrawal
• Network fees (gas fees) are deducted from your balance
• TRX gas fee requirement: Minimum 15 TRX for USDT withdrawals
• Email 2FA verification required for all withdrawals
• Processing time: Instant to 24 hours (depending on verification)
• High-value withdrawals may require additional verification

6.3 Transaction Limits

We reserve the right to impose transaction limits for security purposes. Current limits:

• Minimum withdrawal: $10 USDT / 100 TRX
• Maximum daily withdrawal: As determined by platform security policies
• Withdrawals may be delayed for security review

7. Fees and Charges

7.1 Platform Fees

• Deposits: FREE (0% fee)
• Withdrawals: 2% platform fee
• Network Fees: Variable, based on blockchain congestion

7.2 Fee Changes

We reserve the right to modify our fee structure at any time. Changes will be announced on the Platform and will take effect immediately or as specified in the announcement.

8. Referral Program

8.1 Referral Commissions

Users can earn referral commissions by inviting others to the Platform. Current referral rate is displayed on the Platform and may be adjusted at our discretion.

8.2 Commission Payments

• Commissions are earned from referrals' withdrawal fees
• Commissions are paid automatically to your wallet balance
• Minimum payout threshold applies
• Fraudulent referral activity will result in account termination and commission forfeiture

8.3 Referral Abuse

Creating fake accounts, using bots, or engaging in any fraudulent referral activity is strictly prohibited and will result in immediate account suspension and loss of all commissions.

9. Prohibited Activities

You agree NOT to:

• Use the Platform for any illegal activities, including money laundering or terrorist financing
• Engage in market manipulation, fraud, or deceptive practices
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use bots, scripts, or automated tools without authorization
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with the proper functioning of the Platform
• Upload malware, viruses, or malicious code
• Impersonate other users or entities
• Create multiple accounts to abuse promotions or referral programs
• Use the Platform to store proceeds of criminal activity

10. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Intellectual Property

All content, trademarks, logos, and intellectual property on the Platform are owned by Cryptoffsize or its licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.

12. Disclaimers and Limitations of Liability

12.1 Service Availability

The Platform is provided "as is" and "as available". We do not guarantee uninterrupted access and may suspend or terminate services for maintenance, security, or other reasons without notice.

12.2 Investment Risk

Cryptocurrency investments carry significant risk. The value of cryptocurrencies can fluctuate dramatically. You may lose some or all of your invested capital. We do not provide investment advice.

12.3 Limitation of Liability

To the maximum extent permitted by law, Cryptoffsize shall not be liable for:

• Loss of funds due to user error (wrong address, wrong network, etc.)
• Cryptocurrency price fluctuations
• Network delays or failures
• Unauthorized account access due to user negligence
• Third-party services or blockchain network issues
• Loss of profits, revenue, or business opportunities
• Indirect, incidental, or consequential damages

12.4 Maximum Liability

Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount of fees you have paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Cryptoffsize, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your use or misuse of the Platform
• Any fraudulent or illegal activity

14. Account Suspension and Termination

14.1 Our Rights

We may suspend or terminate your account at any time if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• Required by law or regulatory authorities
• Your account remains inactive for an extended period

14.2 User Termination

You may close your account at any time by withdrawing all funds and contacting support. You remain responsible for all activities before termination.

14.3 Effect of Termination

Upon termination, you must immediately withdraw all funds. If your account is terminated for violation of Terms, we may freeze your funds pending investigation.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Cryptoffsize is registered, without regard to conflict of law principles.

15.2 Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

We will notify users of significant changes via email or platform notification.

17. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including:

• Blockchain network failures or congestion
• Cyberattacks or hacking attempts
• Government actions or regulatory changes
• Natural disasters or acts of God
• Internet service disruptions

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and other policies referenced herein, constitute the entire agreement between you and Cryptoffsize regarding the Platform.
